These Terms govern use of upscalephotoai.com and Upscale Photo AI features. By using the service, you confirm that you may accept these Terms. If you act for an organization, you confirm that you have authority to do so.
The service accepts an image and upscale settings, sends a job to an available AI processor, and, if processing succeeds, provides the result. Available scales, formats, file limits, credit cost, and result availability are shown in the relevant interface or job response.
AI processing can change image details and introduce inaccuracies or artifacts. You must review the result before publishing, printing, selling, or other responsible use.
You are responsible for the accuracy of the information you provide, for keeping sign-in credentials safe, and for activity on your account. Tell support if you suspect unauthorized access. Do not transfer an account in a way that breaks applicable law or the limits of the selected plan.
You keep rights in the uploaded image and the result to the extent provided by applicable law. You grant the service a limited permission to accept, copy, send to technical providers, process, and store the material only as needed to run the job, deliver the result, and provide security and support.
You confirm that you have the rights and lawful basis to upload and process the material, including any needed permissions from depicted people.

Third-party AI processors and infrastructure providers may be used to complete a job. Their availability and technical limits can change. We do not present their services as our own models and do not promise, on their behalf, specific quality, processing locations, or retention periods.
If a feature is paid with credits, the cost is shown before you confirm. Credits are an internal unit of access, not currency, and are not transferable unless the interface or purchase terms say otherwise.
For a paid job, credits may be reserved before the processor runs and charged after a successful result is stored. If the system or provider confirms a final failure before a result is delivered, reserved credits must be restored once. An unknown or still-processing status is not by itself a final failure.

The service is provided as available. We do not guarantee uninterrupted operation, absence of errors, preservation of every detail, a match to subjective expectations, or fitness for a specific commercial, medical, legal, or other professional purpose.
Nothing in these Terms limits warranties or rights that cannot be waived under applicable law.
Code, interface, design, brand marks, and other service elements, other than user materials and third-party components, are protected by applicable law. These Terms do not give you the right to copy, modify, or distribute the service beyond the function we grant.
To the maximum extent allowed by applicable law, the service is not liable for indirect loss, lost profits, or consequences of using an unverified result. This limit does not apply where and to the extent liability cannot be excluded or limited by law.
Governing law and forum are determined by mandatory conflict-of-law, consumer-protection, and other rules that apply to the relationship. These Terms do not take away mandatory user rights.
